Smartphone patent wars: Samsung files request to dismiss $US1 billion patent loss to Apple

Samsung has filed a request to dismiss a $US1 billion patent infringement lawsuit it lost to Apple on the grounds that the foreman failed to disclose crucial information during the jury selection process.

Bloomberg reports the Korean electronics giant is alleging the jury foreman, Velvin Hogan, failed to disclose a personal bankruptcy as well as a 1993 lawsuit by his former employer, Seagate Technology.

Samsung claims that Seagate has a “substantial strategic relationship” with Seagate, and the lawyer who filed the lawsuit against Hogan is married to an attorney who works for the firm that represented Samsung in the trial against Apple.

Hogan defended himself against the accusations.

“Had I been asked an open-ended question with no time constraint, of course I would’ve disclosed that,” Hogan says.

“I’m willing to go in front of the judge to tell her that I had no intention of being on this jury, let alone withholding anything that would’ve allowed me to be excused.”
